I'm pretty sure we got a community here that's pretty experienced when it comes to the yays/nays of Ebay and it's moneygrabbing partner Paypal  :evil:

The situation is i needed a phone battery cause i noticed mine not holding a charge anymore 2 months ago, so i went on Ebay and bought a lot that had 3 batteries + charger. All for $15 shipped (yah, quality can't be great but hey, they can't ALL be lemons), they sent it out on July 29th...guess what, i don't have it yet. I inquired about this to the seller during week 4 of the shipping which is already very patient on my part. They said it could take 3-5 weeks, week 7 rolls along and still nothing. I got fed up and asked for my refund, they replied with stupid answer like go check if it's sitting at your post office. I said f*ck that, i want my refund and reported a claim to Paypal 1 day before it would've been out of their "payment protection"  :roll: time period. Today seller replied with a "would i be interested in them resending the item at no extra charge?" Thing is, i already went online last night and bought a legit battery from The Source (think Radio Shack) for $28. What do i need the jobber batteries for now?

So question is, should i settle for the resend, or be adamant for the refund and risk it going to Paypal Disputes center and have Paypal side with the "Powerseller" and lose it altogether?

Input is greatly appreciated, thnx guys.

Can you link the original auction (or a relisting?) I'd like to see the text in there.

It sounds like you ordered from some place in Hong Kong. I've done that, they ship through the cheapest possible method, and things either get lost or take forever.

Get your refund.  Last time I checked, paypal doesn't side with sellers who fail to deliver.   Does the item have tracking/any of that?

Tell 'em you want your money back.  Paypal will surely side with you, as it's the seller's responsibility to deliver the goods as described, and they can't provide a tracking number or otherwise prove you received your order.

I'm not sure why you are struggling with this one.  You already have a replacement battery.  Even if the Seller turns out to be telling the truth you no longer need the product.  Get your money back.

JKM, that's where i got duped, i clearly did not want to deal with asian seller and the stupid auction says shipping from Jersey... :x
And yes...they got some hoshposh bogus shipping status # they sent me. But all it shows is that they officially sent it out on July 29th...probably just to cover their own asses. But if you guys say i've got a good chance getting $ back from Paypal, i guess i'll go for it. Like Fifty says, i don't need it no more....i should get my cash back for all this friggin inconvenience...

Demand a refund, not a replacement.

I know they're essentially the same thing, but I always handle my disputes through ebay, not paypal.

In the future, stay right on top of the dates. If a seller tells you shipping could take up to five weeks, send then another email and open your ebay dispute right at the end of the fifth week, not week 7. Good luck

You shouldnt have a problem getting your money back. Either through Paypal or via credit card charge back.

I appreciate the gesture of a resend, but if you can understand the inconvenience of not having a working cellphone, I cannot wait another 3-5 weeks for your batteries. I've already ordered a legitimate battery from a local phone store which will arrive in 3 business days. I think it would be much easier for both parties if you just sent a refund for me and there will be no hard feelings for the time wasted.

that listing is a great package (currently own it)
the batterys are legit and that charger lets you keep a battery on the charger, when your phone is in pocket.
i dont know the seller, as i prefer to buy directly from asia (no middle man/faster delivery)

I work in the brunswicks here in NJ. Many people use the address of family or someone in the area for things like this. Always double check anything being sent from anywhere in this area.

REFUND RECEIVED!!! faster then I thought too.

Good to hear you got refunded fast.  I tended to avoid buying oversea sellers on eBay because of long shipping time, unreliable tracking (unless I went with stupidly expensive EMS), and too often items arrive not as described, broken, or never arrives at all.  I've bought games and consoles only from Japan and left rest of Asia on my do-not-buy list.  So far I don't have problem with oversea seller outside eBay (such as this forum's sale section)  I think eBay is making some Chinese, HK, and Taiwan sellers stupid and lazy.

Did you know?

If you get item not as described, and the auction's ship from location is not valid (ie Ships from USA when seller is not in USA) often you can get refund without shipping back.  I had a case I bought a laptop battery from a seller listed in Texas. The tracking # I got a few days later were weird and not in USPS, FedEx, or UPS format. I think it was Chinese post.  I got the battery 3 weeks later and it doesn't fit at all, even though the description stated fits laptop xxxx and replaces battery xxxx that matches mine.  Contacted seller, they claimed I was wrong about my laptop (how can I be wrong? It's printed on my laptop and battery) and stated no refund, exchange only.

Filed claim, eBay said send it back, I pointed to them the seller's listed in Texas but the return address is not Texas. eBay said keep the battery and sent me full refund.

Do not be afraid to ship from overseas. Most of the times, you can ship with the cheapest rate and still arrive. It just depends on the destination, it ships from, and your experience shipping. So far I still say Europe is the most oddest, place to ship from and South America is probably the most hesitant place to ship to, because everybody wants low rates.

All I know I would feel like Princess bubblegum shipping one of her citizens to the Orient regions. Even some pirate, and midi stuff is around their but it is mad expensive.
