10 year old girl gets a bit more than she bargained for with a preloaded media/porn player.  The parents replace it with a new one but keep the old one as evidence (and to enjoy the porn, I'm assuming).

My question is: how can the customer prove that the player came loaded with port and that he didn't put it on there himself in an attempt to frame Wal-Mart?

Most players like Zune and Ipod synch with the computer's clock.. so you probably
could get an accurate date stamp for the files.  But there's ways around that.  If
this goes to court a Computer Forensics guy could pick it apart and figure it out.

If the player is like my RCA Opal, it automatically mounts as a flash drive. You could just right-click on the files and choose Properties and see which party is on the up-and-up.

Well why would they? If the porn was really on there, they wouldn't tamper with it, it would be evidence. They sound like the kind of dipshits who fall for those "YOUR COMPUTER HAS A VIRUS" banner ads, I don't think they could edit that shit.

Go back to the original question:

My point was that the file properties would not be definitive proof of when the files were downloaded to the mp3 player, so some other method would be required to prove that the porn was there before he purchased it and that he's not running a scam.  This dude's level of computer literacy can't be ascertained from what little is in this article, but no matter - it's irrelevant anyway.
