I reported him aswell and sent a nice little email his way "informing" him of "piracy" laws! lol

You know I got ripped off sometime a couple months ago with a guy out of the UK selling Marvel vs. Capcom emulated through mame but selling as an actual game for Windows Vista....I was like ohhh! I jumped on it not thinking to research it and got the game. Nice looking label etc. did a very nice job and opened the case to find a lightscribe disc......The outside label on the dvd case even had a UPC code on it to make it look legit.

I emailed the guy and said hey I want my money or Im reporting you and he was actually a very nice guy about it. He explained that most people dont mind paying for the results that he came out with (very nice homebrew gui). I explained that I wouldnt of minded paying it had I not been jewed into thinking it was REAL.

I got my money anyways and gotta keep it!

After reading a few weeks back about the member here who was selling region-modded PCE systems on eBay and a whiny competitor was getting his auctions pulled, I've been curious to see what it takes to get an auction pulled.

If you report this particular auction, please post in this thread. I suspect eBay needs an insanely high number of reports (100+) before they'll even LOOK at a potentially shady auction, but I'm hoping to be proven wrong here.

Yeah, Acutally the rom was free along with any others...There are tons of sites to download them...I admit I have emulators and tons of roms for almost any system you can think of....I own alot of the actual games but at the same time I dont. The difference between me and him (and all the other douche bags) is that I dont sell them for profit. If anything Ill just give them a copy of it or let them know where to get it at. Some people may still think its wrong to download roms and such but if you do your research its a throw up between whether or not its actually legal. Games that are no longer produced or available to buy in stores (wal-mart, target etc.) is considered to be "legal" to download....NOT LEGAL TO MAKE PROFIT OFF OF....

The main thing that he was selling in the ordeal was that he custom made a Install and Config GUI! Just pop the cd in and click install your done. Then to get into the games you open your .exe file and configure the controls and the game you want to play and it boots up mame and the choosen rom. Its very professionally done but still not worth or right that he makes money off of it.

I got this email In my inbox today; I assume this guy's auction is in violation of the new rules; effective 6/14/2009.

On May 15, eBay will be releasing a revised user agreement. This revision will address the obligations of buyers and sellers in transactions where a buyer has alleged receipt of a counterfeit item.

     These revisions to the user agreement are being made to:
                      # Provide sellers protections against inaccurate counterfeit claims.
                      # Provide buyers assurances about the authenticity of the item received.
                      # Maintain integrity of the eBay marketplace.

     The new User Agreement is effective immediately for new members registering on or after today, and on June 14, 2009, for current members. You don't need to do anything to accept the new User Agreement. If you don't wish to accept it, you can follow these instructions to close your account.

I believe your correct! I saved the link in my fav.s so I could check to see if it got pulled...Between mine and jperryss and anyone elses reports on the auction then It must have gotten pulled.

LOL this seller has been around for YEARS...they always find a way to come back (maybe not lasting...but they always return).

Thanks....I have just undergone a "Re-education Programe" from ebay and i will be removing within the next day or two.

I sell them via a Drop-shipper and they assured me (i think falsely)that they have permmission to sell these items

Good to hear of ebay finally standing up to these profiteering scum.  Surely they'll resurface, but at least you guys are making it a bit harder for 'em to screw people over.

US copyright law is quite clear: the only times that it is legal to download copyrighted material is when you own an original copy, for inclusion in a public library/archive, or for criticism, comment, classroom use, etc.  That said, morality is an entirely different story.
