I doubt e-bay will care or find it in there best interest.  but yeah I think there is more enough on this board alone to be pretty sure he's quite unethical.  I have offered to buy that game from him before, it was listed as a BIN before he had it had it up as an auction, he wouldn't take 45 then either.
