I hate guys like this.  The main thing is claiming it's "like new" when he doesn't even have the original jewel case.  That means no spine sticker either, if you can even live with the fact that the game will never fit into the box properly.  You can't buy anything off of ebay and expect it to be truly new, people just assemble the box, manual, and game from separate sources and pawn it off for "complete" prices.
